To support this, we have introduced the Documents Center: a secure section in the WorkFlex profile where the user can easily upload, organize, and manage important documents, including the employment contract. We understand that this document contains sensitive information, and we want to be transparent about why we ask for it, when it is required, and how the data is handled securely.
Why is the employment contract needed?
An employment contract serves as official proof of employment terms, including role, salary, benefits, and working conditions. When employees work temporarily from abroad, authorities in both the home and host countries may require documentation of employment terms to ensure compliance with local and international regulations.
This is particularly relevant for:
A1 Certificate/ Certificate of Coverage (CoC) Applications: The A1/CoC confirms continued coverage under the home country’s social security system during the stay abroad. Authorities may request the employment contract to verify the employer, the role, and salary details.
Posted Worker Directive (PWD) Registrations: The PWD ensures that employees working in another EU country receive the same working conditions as local workers. Host country authorities may require the employment contract to properly notify the posting and confirm compliance with local requirements regarding salary, benefits, and working hours
How Employment Contract Information Is Used
For Compliance: The employment contract is used exclusively to fulfill legal requirements for cross-border work when requested by local authorities (whether from the country of employment or the destination country). This includes supporting applications for A1 certificates, Posted Worker Directive (PWD) notifications, and responding to information requests from authorities in either the home or host country
Data Security: All documents are stored securely in the Documents Center, accessible only to authorized WorkFlex staff involved in mobility cases. The Documents Center employs robust security measures and is fully compliant with data protection laws, including GDPR.
Transparency: Details about which contract sections are required and how they will be used are always available upon request.
